These Terms & Conditions govern your access to and use of TutorLynk (the "Website", tutorlynk.com), operated by Bright Edutech Pvt Ltd (CIN: U85499WB2025PTC285403). By accessing or using the Website, or by using any of its content or services, you agree to be bound by these terms. If you do not agree, please do not use the Website. In these terms, "we", "our" and "us" mean TutorLynk / Bright Edutech Pvt Ltd, and "you" and "your" mean the user of the Website, whether a tutor, student, parent or guardian.
After discussion with the student, parent or guardian, we may issue an additional set of stipulations regarding fees, number of classes per month and similar matters; those stipulations are treated as being in addition to the terms set out here.
Use of the Website
You acknowledge that we act only as an aggregator that connects tutors with students, parents and guardians. We do not control, and are not a party to, any transaction between a parent and a tutor. You accept the risks involved in dealing with tutors or parents, as the case may be, and those risks are borne by you. The Website is a venue only; we may not screen or otherwise control all listings. We do not mediate, and are not obliged to involve ourselves in resolving, any dispute or disagreement between tutors, parents or guardians.
Termination or suspension
We may at any time terminate, restrict or suspend your access to the Website, for any reason or no reason, with or without prior notice, and without liability.
Changes to these terms
We may update or modify these terms at any time without prior notice. Your continued access to or use of the Website after any change constitutes your acceptance of the updated terms. You are advised to review this page from time to time to stay aware of the latest terms as published on tutorlynk.com.
A. Terms for Students, Parents & Guardians
Fees and payment model
Our fee model works as follows:
- Online tuition: the student, parent or guardian pays the monthly fee in advance to TutorLynk, online to our bank account, for each month, to continue availing the tuition service. We pay the teacher from our end; the student need not pay the teacher anything extra.
- Offline tuition: for the first two months, the full monthly fee for each month must be paid to TutorLynk in advance at the beginning of each month; we pay the teacher from our end. From the third month onwards, the teacher collects the full monthly fee directly from the student after completing the month's classes.
- If you engage more than one teacher (online or offline) at any time, you must pay separately for each tuition.
- On request, we may arrange one trial class. If the student is satisfied and continues, that trial class is treated as the first class of the month and charged accordingly. If the student does not continue after the trial class, nothing is payable.
- For a teacher to continue, the monthly fee must be paid to TutorLynk as applicable. In offline mode, payment is made in advance before the tuition starts.
Advance payment. You acknowledge that TutorLynk may collect up to two months' tuition fees in advance for a tuition, and settles the teacher's payment from its end during that period, in accordance with the model above.
Refunds
Monthly tuition fees are non-refundable. In online mode, fees paid in advance are non-refundable. Any refund, if made at all, is entirely at the sole discretion of TutorLynk. We may revise subscription arrangements at our sole discretion.
Replacement of a teacher
We may replace a teacher where we consider it necessary and arrange for the remaining classes of that month to be completed. If a replacement is required, any dues of the existing teacher will be adjusted from the advance already paid, and the arrangement with the new teacher is treated as a new contract; for the first two months you may again be required to pay in advance as applicable, with only the balance of the newly finalised amount collected after deducting the earlier teacher's applicable dues (as finalised by TutorLynk). On replacement, the monthly fee may increase without prior notice, and you agree to comply. A replacement request must be made within two days of termination of the existing teacher, and applies only to the same student, class, subject and location; it is not transferable. No refund is made in connection with a replacement.
Meaning of "one month"
"One month" means the total number of classes to be delivered within a period of 30 days. If the agreed number of classes for those 30 days is exhausted before the period ends and fresh classes begin beyond the agreed number, that is treated as the start of a new month and is separately chargeable.
Classes, scheduling and mode
The mode of classes (online and/or offline) is decided by TutorLynk from time to time and communicated to the student and teacher, who are bound to adopt it. Online classes are conducted through Zoom, Google Meet, Google Hangouts, Jio Meet or any other suitable application; accessibility of such third-party applications is not guaranteed by us, and we are not liable for any inability to access them. The student must cooperate in all reasonable ways for a class to take place. If a student fails to attend a scheduled class, that class is treated as validly delivered and counted, and the teacher may at their discretion arrange a make-up class. If a teacher misses a scheduled class, the teacher will rearrange it in consultation with the student at a mutually convenient time. For any cancelled class, we will try to help rearrange it, provided the student or teacher informs us in advance with adequate time. If the student changes address, the teacher may try to attend but is not obliged to travel to the new location; this must be brought to our notice.
Project work
For project work, full payment is taken in advance, and the completed project is delivered to the student online or offline, through a channel decided by TutorLynk. If there is any issue with a project, the student may approach us and we will try to provide the best possible complete project.
Additional students
If additional students — including but not limited to siblings, relatives, friends, or others referred by the parent or guardian — join the tuition provided by our recommended teacher, the total monthly tuition fee is adjusted upward. The obligation to pay the increased rate applies regardless of whether the additional students are taught at a different time, on different days, or at a different location from the initial student.
Consultation / registration charge
In special cases, TutorLynk may take a one-time non-refundable consultation or registration charge from the student. In that case, the student pays the teacher separately from the very first month.
Communication
All complaints, feedback and other communication must be made only from the student's registered phone/WhatsApp number, by WhatsApp, phone call or SMS. TutorLynk is not bound to respond to email communication, and communicates with students only by phone call, SMS or WhatsApp. When you contact us through any such channel, or by visiting or submitting details on tutorlynk.com, it is presumed that you have read, understood and accepted these terms. When a teacher's details are shared with you, you must contact the teacher through the shared details. You must keep TutorLynk updated about all developments at every stage, and must inform us and pay us as per these terms as and when a tuition or assignment is finalised.
Payment reminders and recovery
Any payment reminder sent by TutorLynk through WhatsApp, SMS or phone call must be treated as a valid notice to pay immediately, and you must act on it. If you fail to pay, TutorLynk may take any legal action it considers necessary to recover its dues without further notice, and all costs and expenses of recovery are borne by the customer. TutorLynk may send a representative to the student's place, without prior intimation, to collect or recover its dues, and the student and/or teacher must cooperate in all respects.
Cancellation by the student
If a student or parent cancels a teacher at any time, any dues payable to TutorLynk must still be paid. If you have already paid TutorLynk and then cancel the existing tutor, we will arrange for the remaining classes to be completed by replacing the teacher. If a teacher increases the number of classes on a monthly basis, the corresponding increased monthly rate becomes payable to TutorLynk as applicable.
Liability, indemnity and taxes
TutorLynk's liability is limited to arranging a teacher for you. We do not guarantee the character or conduct of a teacher, though we try to send a suitable teacher. We take no responsibility for any undesirable or untoward incident in online or offline teaching, and no legal action may be taken against TutorLynk in respect of such incidents, although we will try our best to support the customer or teacher. You agree to indemnify and defend TutorLynk in respect of any incident arising out of your conduct, and this indemnification survives any cancellation of this agreement. Any government tax or GST is borne and paid by the customer. Any false information provided by a student will be dealt with according to the law. Any resolution provided by TutorLynk to a complaint is treated as the final resolution binding on all parties. No action, in any form, arising out of or relating to these terms may be brought by either party after 15 days from the date on which the cause of action arose. Before approaching a court, the student or parent must inform TutorLynk in writing by registered courier.
Minors' consent
Any personal data relating to a minor that you provide is deemed to be given with the consent of the minor's legal guardian, and such consent is deemed provided by you at the time of registering with TutorLynk.
Use of your information
We may use the personal information you provide to contact you from time to time about the service, important information, payments due to TutorLynk, other notices, and promotions. For online tuition, after understanding your requirement, we will inform you of the quotation or amount payable through WhatsApp, SMS or phone call.
B. Terms for Teachers
By submitting your information on the Website, or by communicating or sharing through phone call, SMS or WhatsApp, you agree to and accept these terms. For any existing or new teacher availing our services in any manner, or taking a lead (a student's contact details or any other details), you agree to abide by these terms.
Payment to the teacher
- Offline tuition: you will not take any payment from the student for the first two months. You receive 50% of the monthly fee for each of the first two months from TutorLynk, after completing at least 50% of the classes. From the third month onwards, if the tuition continues, you collect the full monthly fee directly from the student.
- Online tuition: you receive 50% of the monthly fee for each of the first two months from TutorLynk, after completing at least 50% of the classes. From the third month onwards, if the tuition continues, you receive the full monthly fee from TutorLynk, after deduction of applicable charges.
- You must continue for the first two months after we confirm that the student has paid the required fees.
- If a tuition discontinues within the first two months — whether at the student's will or on our instruction — you receive part payment, if any, as decided by TutorLynk, and that amount is final and cannot be challenged. If the tuition discontinues due to your failure to satisfy the student, you receive nothing.
- If you fail to give online classes at the scheduled time and the student is dissatisfied and unwilling to continue, you are not entitled to any payment.
Commission for leads. You acknowledge that TutorLynk may charge a service charge or commission for providing you with tuition leads and assignments, at the rate applicable and communicated by TutorLynk, and you are bound to pay that amount as per these terms.
Registration charge, trial classes and dues
You have no claim over any registration or consultation charge received by TutorLynk from a student; in such cases you may take advance payment from the student and remain bound to pay TutorLynk its dues. Even after receiving an advance at any point, if TutorLynk asks you to discontinue, you must comply. If a student does not pay in advance and discontinues after some classes, TutorLynk does not guarantee your payment; if we recover it, we share it with you after deducting our charges. If you collect fees from a student during the first two months of offline tuition (which you are ordinarily not entitled to under this agreement), you must pay TutorLynk its dues immediately. You may be asked to give trial classes, which are not chargeable.
Conduct of tuition
When you accept a tuition, you cannot refuse or discontinue on the pretext of travel difficulty or any other reason. If the student changes location, you are not bound to travel to the new place (subject to further agreement). You must not take any fee or payment other than the monthly fee from the student. You must attend the student's place at the scheduled time; if you fail to and the student discontinues as a result, TutorLynk takes no liability. The mode of classes (online or offline) is decided by TutorLynk and is final. After a tuition is finalised, you must make every effort to enable TutorLynk to collect its dues smoothly. For online tuition, you must share the required link or details with the student in advance, and must record the online classes so that any subsequent dispute can be resolved using the recording as proof. If you miss a scheduled class, it is your responsibility to make it up at the student's convenient date and time (for both online and offline modes).
Mandatory disclosure, fee modification and conduct
You must immediately inform TutorLynk if any additional student(s) join the tuition — including siblings, relatives, friends, or others referred by the parent or guardian of the initial lead. On such enrolment, the total monthly fee is revised upward, and you must pay the appropriately revised platform fee/commission to TutorLynk, effective from the additional student's first session or enrolment. This duty applies regardless of whether the additional students are taught at a different time, on different days, or at a different location. Failure, omission or delay in reporting or paying the revised fees is treated as a strict breach of trust and a direct violation of these terms; TutorLynk may recover back-dated fees, impose financial penalties, or terminate your empanelment immediately. You must maintain the highest standards of professional ethics and conduct; TutorLynk and/or the student or parent may take legal action for ill behaviour, misconduct or any other valid reason without prior notice, and all resulting legal, administrative and incidental expenses are borne entirely by you.
Mode of communication, responsiveness and right to contact
You agree that TutorLynk has the absolute right to contact you whenever necessary for business operations, tuition updates, payment recovery or any other professional purpose. TutorLynk has the exclusive right to choose any convenient mode of communication — including voice calls, WhatsApp calls, WhatsApp messages, SMS, email or any other channel — and you cannot dictate or restrict which channel we use. You are strictly prohibited from blocking our official phone numbers, WhatsApp accounts or email addresses; avoiding calls, ignoring messages or cutting off communication is a zero-tolerance violation. You are bound to attend all calls and acknowledge all communications promptly, and to reply immediately; where an immediate reply is impossible due to an ongoing class or emergency, you must call back or reply at the earliest opportunity on the same day. Any attempt to block us, systematically avoid calls, dictate communication preferences, or fail to respond within the same calendar day is treated as a material breach, upon which TutorLynk may immediately suspend or permanently terminate your registration, withdraw ongoing assignments, and initiate legal proceedings for any unrecovered dues or damages.
Direct payments and immediate settlement of dues
If a student or parent pays you directly for any reason, the share/commission due to TutorLynk must be transferred and settled immediately. You are required to remit dues online (for example via UPI, IMPS or Net Banking) on the exact same day the payment is received, regardless of weekends, public holidays or bank closures; as digital payments operate 24/7, non-banking days are not accepted as an excuse for delay. TutorLynk may send a representative to the teacher's or student's place, without prior intimation, to collect or recover its dues, and you must cooperate. Any delay in remitting dues immediately upon receipt is treated as a material breach, resulting in immediate suspension of your profile, forfeiture of future assignments, and potential legal action for withholding company funds.
Late payment penalties and recovery costs
If you fail to remit dues on the exact calendar day they are received (regardless of weekends or holidays), a flat late-payment penalty of ₹500 or 30% of the total outstanding amount, whichever is higher, is applied to your account immediately, and you agree to clear it alongside the principal. For every subsequent day the payment remains unpaid, an additional recurring fine of ₹100 per day accumulates until the entire balance — principal dues, the initial late fee, and all accumulated daily fines — is cleared in full. You are strictly bound to bear and reimburse all extra costs and expenses incurred by TutorLynk in recovering overdue funds, including administrative collection and communication charges, travel or field-verification costs of platform executives, and legal fees (including drafting and serving formal legal notices through an advocate). TutorLynk may freeze your active assignments and suspend your profile during non-payment, while the daily penalty continues to accrue.
Verification and sharing of tutor credentials
You grant TutorLynk permission to share your academic credentials, marksheets, certificates, experience certificates and verified identity proofs (including masked government IDs) with prospective clients, parents or guardians, solely for profile verification, qualification matching and securing assignments. This authorisation remains valid throughout your association with TutorLynk; even after an assignment has commenced, we may share these documents with the active parent or guardian at their request for further verification, safety compliance or academic reassurance. You warrant that all documents submitted are genuine, accurate and unaltered. TutorLynk acts strictly as a facilitator for verification and is not liable for any misuse or unauthorised handling of these documents by parents or clients once shared in good faith. TutorLynk may display the profiles of all or selected teachers on the Website at its discretion.
Anti-defamation, intellectual property and legal remedies
You shall not make, publish, post, broadcast or circulate any false, defamatory, malicious or derogatory statement, review or comment against TutorLynk, its management or its platform on any public or digital platform — including Google Reviews, Facebook, Instagram, LinkedIn, YouTube or online consumer forums — without verifiable, lawful proof. If you engage in a baseless smear campaign or attempt to defame the platform with malicious intent, TutorLynk may initiate civil and criminal proceedings under the Bharatiya Nyaya Sanhita (BNS) and the Information Technology Act, and may produce all available evidence — including submitted credentials, agreements and electronic records such as WhatsApp and email logs — before authorities, police or a court. You agree to indemnify and hold TutorLynk harmless from any financial loss or damage to goodwill or brand resulting from such actions, and to reimburse all legal expenses, court fees and advocate fees incurred if we are compelled to take legal action.
Post-termination obligations
Termination or suspension of your registration does not absolve you of existing financial liabilities. If a tuition assignment is ongoing at the time of termination, you remain bound to clear all outstanding dues for the leads already provided; you cannot claim to terminate these terms in order to avoid payment, and TutorLynk will collect its rightful fees for all existing assignments immediately and unconditionally. As long as you continue to provide services to any student initially introduced by TutorLynk, you must maintain all behavioural duties, ethical standards and professional guidelines, and perform your services properly and in good faith. If a dispute or complaint arises regarding an existing or past assignment provided by TutorLynk, you are bound to answer all communications, cooperate with our investigation, and respond through our chosen channels. Any failure to remit dues post-termination, any drop in professional behaviour, or any refusal to communicate about a dispute is treated as a severe breach of surviving obligations, upon which TutorLynk may recover damages, notify the parents of your breach, and pursue civil or criminal remedies at your sole expense.
Behaviour and legal action
You must be polite and well-behaved; otherwise your relationship with TutorLynk stands cancelled without prior notice and no subsequent payment is made. When we give you a lead (a student's name, contact number or other details) by phone, SMS or WhatsApp, you are bound to accept these terms, contact the student immediately, and update us at every stage. You must inform and pay TutorLynk as and when you finalise a tuition, assignment or project work from a lead we provide. We make every effort to send you to a safe place; if you find the place or student uncomfortable, you may bring it to our notice. You may take legal action against a student, but TutorLynk is not responsible in any manner. For project work, you are paid after delivering the project to TutorLynk in soft or hard copy as required; we may reject a project, in which case you are not entitled to payment.
C. General Terms
Intellectual property
The TutorLynk name, logo, website, mobile application, software, content, trademarks and branding are the exclusive property of Bright Edutech Pvt Ltd. No part may be copied, reproduced or used commercially without prior written permission.
Force majeure
TutorLynk is not liable for any delay or failure to perform its obligations due to events beyond its reasonable control, including natural disasters, pandemics, government restrictions, internet outages, strikes or other force majeure events.
Acceptable use
You must not create fake accounts, provide false information, impersonate another person, misuse tutor or student information, harass, threaten or abuse any user, or use TutorLynk for any unlawful purpose. We may suspend or terminate any account that violates these rules.
Fraud and misrepresentation
Providing false, misleading, forged or fraudulent information or documents may result in immediate suspension or permanent removal of the account, without prejudice to any other legal remedies available to TutorLynk.
Non-circumvention
Tutors, students, parents, guardians, schools, coaching centres and educational institutions introduced through TutorLynk must not bypass the platform to avoid paying the agreed service charge or commission. If any assignment or employment is finalised using information or introductions provided by TutorLynk, the applicable commission remains fully payable, regardless of whether the parties later communicate or transact directly.
Electronic acceptance
By registering an account, submitting a form, verifying your mobile number through OTP, clicking "I Agree", making any payment, or continuing to use TutorLynk, you acknowledge that you have read, understood and accepted these Terms & Conditions, which constitute a legally binding agreement between you and TutorLynk.
Jurisdiction
These terms are governed by the laws of India. Any dispute arising out of or touching this agreement is subject to the sole jurisdiction of the competent courts at Malda, West Bengal. Before approaching a court, the student, parent or teacher must inform TutorLynk in writing by registered courier.
